JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-11-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 08.07.2015 on the accusation that he caught the hair of victim from outside the window of her house and threatened her and also abused her. The statement of victim was recorded on 29.05.2015 i.e. near about after two months of the alleged occurrence and in the aforesaid statement, victim developed her story and stated that petitioner having entered into her home removed her clothes and also bite on her lips.

Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs.

Patna High Court Cr.Misc. No.38240 of 2015 (3) dt.06-11-2015 2/2 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I, Saharsa in connection with Special Case No. 03 of 2015 arising out of Nauhatta P.S. Case No. 61 of 2015.
