Petitioner seeks bail in connection with Warsaliganj P.S. Case No. 263 of 2018 registered for the offence punishable under sections 302/34 of the Indian Penal Code.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case merely because he is Dewar/Bhaisur of the informant. Neither there is anything specific alleged against this petitioner nor there is any eye witness to the alleged occurrence. Petitioner is in custody since 01.08.2018. Learned Addl. No.38274 of 2019(3) dt.13-09-2019 2/2 learned counsel appearing for the informant opposes the prayer for bail and submits that petitioner is named in the first information report. The injury report supports the allegations levelled against this petitioner. He, therefore, submits that petitioner does not deserve to be granted the privilege of bail.

Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
