JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-02-2022 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302/201/34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with other accused persons committed the murder of daughter of informant and threw her dead body in a well.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case only on suspicion. It is submitted that marriage was solemnized in the year 2003 and till the date of occurrence there was no complaint against this petitioner for demand of dowry. It is next submitted that deceased died on account of falling in well. There is no eye witness of the occurrence. Petitioner

Patna High Court CR. MISC. No.44943 of 2021(4) dt.21-02-2022 2/2 claims clean antecedent and is in custody since 13.04.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that petitioner is husband of the deceased and there is direct and specific allegation against him of committing the murder of daughter of informant. In the post mortem the doctor found external injury on the body of deceased.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected.
