Mr.Ram Sumiran Rai ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-08-2019 Heard learned counsel for the petitioners and learned APP representing the State.

Petitioners are father-in-law and mother-in-law respectively of the deceased who are seeking anticipatory bail in connection with Patepur P.S. Case No.179 of 2018 registered for the offence punishable under Sections 304(B)/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the marriage between the deceased and the son of these petitioners had taken place in the year 2013, but thereafter the husband and other family members including these petitioners were demanding dowry and it is a case of dowry death in which in course of postmortem some kind of injury has been found on the body of the deceased besides the ligature mark around the neck.

Patna High Court CR. MISC. No.33464 of 2019(3) dt.06-08-2019 2/2 Learned APP for the State submits that in the case diary so far as the allegations of demand of dowry and torture are concerned, there are general and omnibus allegations against these petitioners. There is no specific instance of commission of any assault by these petitioners and no independent witness has come forward to say that these petitioners had ever indulged in beating or committing cruelty.

In the given facts and circumstances of the case where in course of investigation, no material has been collected against these petitioners so as to make any specific allegation against them and they are said to be the father-in-law and mother-in-law respectively, let the petitioners above named in case of their arrest or surrender within four weeks from today in connection with Patepur P.S. Case No.179 of 2018, be released on bail on execution of bail bonds of Rs. 15,000/- (fifteen thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-X, Vaishali at Hajipur, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
