The petitioner seeks bail in a case registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code.

The informant named six persons in the FIR and alleged that Reza Alam assaulted his father with spade on his head and Naushad assaulted with stick. Father of the informant became unconscious and fell down. Abdul Nazir the uncle of the informant also got injuries. Allegation against the petitioner is that he called the accused persons and on the order of Abdul Jabbar the accused persons assaulted his father. There is no allegation of assault against the petitioner. The order giver Abdul Jabbar has already been enlarged on bail vide orders passed in Cr. Misc. No. 35435 of

Patna High Court Cr.Misc. No.40536 of 2015 (2) dt.03-09-2015 2/2 2015.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in Chakia P.S.
