2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 323, 324, 307, 379, 325, 447, 504, 506, 34 of the IPC.
3. As per the prosecution case, due to some land dispute, the petitioner along with other co-accused persons have assaulted the informant with iron rod due to which he got injured.
4. Learned counsel for the petitioner submits that as many as five persons have been named in the first information report as an accused although, it would be evident from the F.I.R. itself that the parties to the proceeding are
Patna High Court CR. MISC. No.34824 of 2026(3) dt.11-06-2026 2/3 patidars and had a dispute with regard to the land and tree, which resulted in the present occurrence. The specific allegation is upon one Randhir Kumar and the present petitioner and the allegation upon the petitioner is that he inflicted a blow by iron rod on the head of the informant which caused injury on the right forearm. The injury Report (Annexure P/4) indicates the presence of three injuries on the person of the informant and injury no. 3 seems to be attributable to the present petitioner which is in the form of swelling over right wrist. However, upon X-ray, a hair line fracture has been found and the nature of injury in general has been opined to be grievous in nature caused by hard and blunt substance.

It is submitted that there is case and counter case and the case filed on the petitioner side is rather earlier in point of time (Annexure P/3) and the petitioner is also injured which would be evident from Annexure P/3. There is no allegation of assaulting on any vital portion of the body nor any allegation of repetition of blow, as such, Section 307 of the I.P.C. would not be attracted. The petitioner is languishing in custody since 16.03.2026 with no criminal antecedents.

Taking into consideration the facts and circumstances of the case and also considering the land dispute between patidars and existence of case and counter case resulting in injuries on both the sides, let the above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 9th (East), Muzaffarpur/concerned Court below in connection with Bochaha P.S. Case No. 251 of 2023.
