JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03-09-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. No doubt, petitioner was caught on the spot but admittedly, nothing was recovered from his conscious possession and the petitioner is languishing in jail custody since 05-06-2015 and the date of remand of the petitioner reflects that he was remanded in the present case after 13 days of the present occurrence, particularly, in the circumstance, when he was caught on the place of occurrence just after the alleged occurrence. Moreover, the petitioner does not have any criminal antecedent.

Accordingly, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Ahiyapur P.S. Case No. 429 of 2015 to the satisfaction of Chief Judicial Magistrate, Muzaffarpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
