The petitioner seeks bail in S.T. No. 185 of 2021, arising out of Naugachhia P.S. Case No. 109 of 2020, registered for the offence under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, this petitioner shot dead the son of the informant.

It is submitted on behalf of petitioner that informant is not eye-witness of the occurrence and petitioner has been falsely implicated in this case due to old enmity. He is in custody since 09.02.2021.

However, learned A.P.P. for the State opposed the bail petition and submitted that petitioner is assailant of the deceased.

Patna High Court CR. MISC. No.44848 of 2021(4) dt.28-02-2022 2/2 Considering the nature of accusation and gravity of offence, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
