The petitioner is languishing in custody since 17.12.2018 in a case registered for the offences punishable under Sections 272, 273 and 308 of the IPC and Sections 30, 36, 38 and 41(1) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from the motorcycle of the petitioner, 2.700 litres of Indian Made Foreign Liquor were recovered. It is submitted by learned counsel for the petitioner that the petitioner has maliciously been framed in the present case. A statement has been made in paragraph no.3 of the petition that the petitioner is accused in one other case also, in which he is on bail.

Learned APP submits that recovery has been made from

Considering the nature of recovery and period under custody, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with Hussainganj P.S.
