The petitioner is in custody in connection with Special Case No. 2953 of 2019 arising out of Maner P.S. Case No. 134 of 2019, registered for the offence punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. He further submits that in the instant case total 45 liters of country made liquor was recovered, but from the possession of the petitioner total 15 liter country made liquor was recovered. Learned counsel for the petitioner would submit that petitioner is in custody in this case since 18.03.2019.

Considering the facts that petitioner has no criminal

Patna High Court CR. MISC. No.34979 of 2019(2) dt.28-05-2019 2/2 antecedent and he has remained in custody for more than two months, let the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Special Judge, (Excise) Patna in connection with Special Case No. 2953 of 2019 arising out of Maner P.S. Case No. 134 of 2019.
