2. The petitioners apprehend their arrest for the offences alleged under Sections 103, 238, 3(5) of the BNS, registered in connection with Manpur P.S.Case No. 29/2025.

3. As per allegation, the petitioners killed the daughter of the informant by pressing her neck.

4. The learned counsel appearing on behalf of the petitioners has submitted that petitioner no.1 is father-in-law, petitioner no.2 is brother-in-law, petitioner no.3 is mother-in-law and petitioner no.4 is gotni of the deceased. The husband Suraj

Patna High Court CR. MISC. No.34882 of 2025(4) dt.17-11-2025 2/3 Ram has been granted regular bail by a coordinate Bench of this Court in Cr.Misc.No. 35001 of 2025. While granting bail to the husband, the coordinate Bench has gone through the statement of the independent witnesses in para-54 and 61 of the case diary who submitted that some quarrel was there before the occurrence and she committed suicide thereafter. The learned counsel has further submitted that the investigating authorities did not find it a case of Section 103 of the BNS and chargesheet has been submitted under Section 108 of the BNS, which is abetment to commit suicide.

On the other hand Mr. J.N.Thakur, the learned APP for the State has opposed the prayer for anticipatory bail by submitting that the burn injuries were found on the person of the deceased, to which the learned counsel for the petitioner replied that according to the FIR, she was strangulated to death and in course of cremation, the injuries were there on her body. He submitted further that this fact is corroborated by the postmortem report. The injuries were not ante-mortem, rather those were post-mortem.

6. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of

No.34882 of 2025(4) dt.17-11-2025 3/3 this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned ACJM, 1st Bettiah, West Champaran in connection with Manpur P.S.Case No. 29/2025, subject to the conditions as laid down under Section 438(2) CrPC/482(2) of the BNSS.
