The petitioner seeks bail in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code, Sections 3/4 of the Explosive Substances Act and different Sections of the Unlawful Activity Prevention Act. The petitioner is not named in the FIR. Nothing has been recovered from the possession of the petitioner. The petitioner was arrested on the allegation that the petitioner gave shelter to the named accused on the basis of such finding of the I.O., the motorcycle which was used by the accused, was recovered from in front of the house of the petitioner. It is submitted that one of the named accused Ashok Kumar has already been enlarged on bail vide orders passed in Cr.
Patna High Court Cr.Misc. No.41100 of 2015 (2) dt.10-09-2015 2/2 Misc. No. 30427 of 2015.
Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Patna City, Patna in Agamkuan P.S. Case No. 132 of 2015.
