2. A prayer for bail has been made on behalf of the petitioner in connection with Kesariya P.S. Case no.126 of 2026 registered under sections 318(4), 338, 336(3), 340(2) and 61(2) of BNS, 2023.

3. Allegation in the F.I.R is that co-accused Naz Ahmed Khan in conspiracy with petitioner procured and caused the preparation and submission of forged verification report to obtain a second arms license.

4. Learned counsel for the petitioner submits that petitioner is a mere chowkidar at Kesariya Police Station and he has been made a scape goat in the entire incident by stating that he has given a false report with regard to criminal antecedent of

It is further submitted that the enclosure dated 16.02.2026 would reveal that no adverse entry existed against the licence holder and as such a recommendation was made in respect of the said licence. The said document bears the signature of the informant, who was serving as the Officer-inCharge of the concerned police station at the relevant time. Learned counsel further submits that no opinion of a handwriting expert has been obtained during the course of investigation to establish that the signature appearing on the document is forged. The petitioner is a semi-literate chowkidar and he is in custody since 23.03.2026. He undertakes to cooperate in the case/trial. Charge-sheet has been submitted in the case.

5. The application for bail is opposed by learned A.P.P. for the State.

6. Taking into consideration the aforesaid facts and circumstances of the case and also considering the fact that petitioner is only a chowkidar having no criminal antecedent and coupled with the fact that charge-sheet has been submitted, the petitioner is directed to be enlarged on bail in connection with Kesariya P.S. Case no.126 of 2026 on furnishing bail bond
