JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-12-2020 Heard Mr. Satyendra Rai, learned counsel for the petitioners and learned APP for the State. The petitioners seek bail in connection with Kuchaikote P. S. Case No. 234 of 2020 dated 22.06.2020, instituted for offences under Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act, 2016 and Bihar Prohibition and Excise (Amendment) Act, 2018.
It appears from the prosecution report that 1752.480 litres of liquor was recovered from a vehicle of which petitioner no. 1 is said to be the Driver and the
Patna High Court CR. MISC. No.33547 of 2020(2) dt.16-12-2020 2/2 petitioner no. 2, the cleaner.
The learned counsel for the petitioners has submitted that they did not have any idea that the vehicle was loaded with liquor.
The petitioners are in custody since 23.06.2020 and are persons of clean antecedents.
Considering the afore-stated facts, the petitioners, above-named, are directed to be released on bail on their furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge - 2nd cum Special Judge, Excise, Gopalganj, in connection with Kuchaikote P. S. Case No. 234 of 2020.
The petition stands allowed.
