Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner seeks bail in anticipation of his arrest in connection with Morkahi P. S. Case No. 13 of 2020 (G.R. No. 286 of 2020) instituted for the offences under

Patna High Court CR. MISC. No.45471 of 2021(3) dt.26-04-2022 2/3 Sections 147, 341, 323, 354(B), 427, 379, 504 and 506 of the Indian Penal Code.

As per allegation, when the informant, Rubi Devi was returning to her house, the F.I.R. named accused persons abused her and also opened fire. The allegation against the petitioner is that he forcibly thrown her on the ground after catching her hairs.

The learned counsel for the petitioner has submitted that both the parties are agnates and there is a land dispute between them.

Considering the above-mentioned facts and circumstances, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Khagaria in connection with Morkahi P. S. Case No. 13 of 2020 (G.R. No. 286 of 2020), subject to the conditions as laid down under Section 438 (2) Cr.P.C.

The application stands allowed.

Patna High Court CR. MISC. No.45471 of 2021(3) dt.26-04-2022 3/3 Office shall ensure that all the defects are removed by the petitioner within the stipulated time provided in para 1 hereinabove, failing which the matter shall be brought to the notice of this Court.
