The petitioner apprehends his arrest in Complaint Case No. 859/2013, registered for the offences punishable under Section 406 of the Indian Penal Code.

The complainant alleged that he purchased a vehicle Chevorlet from Pandey Motor Private Ltd. Thereafter, he issued a cheque of Rs. 40,000/- for registration of the vehicle, but later on, the petitioner being the manager of the company informed that the cheque was bounced. Therefore, registration of the vehicle could not be done in proper time.

No.40810 of 2015 (2) dt.06-10-2015 2/2 He further alleged that on account of such delay vehicle was not registered in time and he could not claim the insurance amount when the vehicle met with an accident. It appears that the cheque given by the complainant was not honoured and that is why some delay was caused in the registration of the vehicle. The complainant later on, gave money and registration was done.

Considering the facts and nature of allegation, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Madhubani in connection with Complaint Case No. 859/2013, subject to the conditions as laid down under Section 438(2) of the Cr.
