The petitioner is in custody in connection with Dumraon P.S. Case No. 134 of 2019 for the offences under Sections 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 07.04.2019.

Referring to the prosecution case he submits that petitioner the allegation against this petitioner is that he was involved in theft of motorcycle. He further submits that petitioner was not named in the F.I.R. and the name of the petitioner surfaced on confessional statement of co-accused. Considering the fact that petitioner has no criminal antecedent and the name of the petitioner surfaced on
