JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-09-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.01.2014 and the letter no. 144 dated 01.05.2018 of the learned 2nd Additional Sessions Judge, Araria goes to show that the charge against the petitioner could be framed on 27.03.2018 and up till now, only two prosecution witnesses could be examined.
However, it is submitted on behalf of the petitioner that the name of this petitioner came in this case in the statement of Ramesh Goswami, whose statement was recorded by the Investigation Officer at Para- 11 of the case diary but subsequently, the aforesaid Ramesh Goswami was also made accused by the police. It is further submitted that co-accused
Patna High Court Cr.Misc. No.2621 of 2018 (11) dt.05-09-2018 2/2 Ramesh Goswami has already been granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 19.07.2013 passed in Cr. Misc No. 9204 of 2013 (S. T No. 707 of 2012). Considering the aforesaid facts and circumstances as well as submissions of the parties, and also taking note of stage of the trial as well as period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Araria in connection with Session Trial no. 189 of 2014 arising out of Narpatganj P.S.Case No. 50 of 2007/ G.R.No. 280 of 2007, subject to the condition that one of the sureties must be a close relative of the petitioner and shall swear an affidavit to this effect as to how he/she is related to the petitioner.
