Heard the learned counsel for the petitioner and learned APP for the State.

The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 149, 323 and 504 of the Indian Penal Code as well as Sections 25(1-b) a, 26 and 27/35 of the Arms Act, registered in connection with Bidupur P.S.Case No. 215 of 2012.

As per allegation, the accused persons named in the FIR were opening fire in air and they also surrounded the house of Rajneta Singh where one Jimiya was taking shelter.

No.45362 of 2021(2) dt.13-04-2022 2/2 The learned counsel for the petitioner has submitted that no one has been injured and the petitioner is the person of clean antecedents. He has submitted further that good sense has prevailed upon both sides and they have compromised their disputes. A xerox copy of the compromise petition has been annexed with the bail petition.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Vaishali at Hajipur in connection with Bidupur P.S.Case No.215 of 2012, subject to the conditions as laid down under Section 438(2) Cr. P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
