Learned Counsel for the petitioner submits that the petitioner had appeared in the examination vide Advertisement No. 01 of 2003 for appointment under Group D post in Railway, in which he was declared successful. But, subsequently, due to mismatch of signature and thumb impression he was declared unsuccessful, therefore, he has filed the present writ petition.

Learned Counsel for the Union of India submits that the counter affidavit has been filed in which stand has been taken by the Union of India that the case of the petitioner is relating to appointment on Group D post in Railway published by the R.R.B., Patna. Counsel submits that the writ petition is
Patna High Court CWJC No.8518 of 2018(3) dt.27-09-2024 2/2 not maintainable due to the fact that the petitioner has earlier approached before the Central Administrative Tribunal, Patna for redressal of grievances in O.A. No. 050/00780/2015 which was dismissed on 09.03.2016 and against the order of dismissal the petitioner has not moved any further and instead thereof the petitioner has filed the present writ petition suppressing this fact that his case was earlier dismissed before the Central Administrative Tribunal, Patna.
4. In this view of matter, this Court finds that there is no merit in the present writ petition. Hence, the present writ petition stands dismissed.
