Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in a case registered under Sections 341, 323, 376, 354(B), 379, 504, 506/34 of the Indian Penal Code.

Allegation is that the petitioner touched the private part of the victim and outraged his modesty and snatched the chain from her neck and torn her clothes.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.08.2020 and has got no criminal antecedent. Charge sheet has been submitted in this

Patna High Court CR. MISC. No.33601 of 2020(3) dt.15-01-2021 2/2 case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in this case. There is no medical examination report of the victim nor there is any statement of the victim made under Section 164 Cr.P.C. on record. The present case has been instituted for oblique reasons.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. XIV, Hajipur in connection with Lalganj P.S. case No.84 of 2020. (Sudhir Singh, J) Narendra/- U T
