JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 07-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 307, 506/34 and other allied sections of Indian Penal Code and Section 27 of Arms Act.
As per prosecution case, informant's son was called by the co-accused persons including this petitioner and later on she heard a gun shot after which she saw them running away with a pistol.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to village politics. Moreover, prosecution story is falsified by the injury report wherein the injury has been found to be caused by hard and blunt substance. Injury is simple in

Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Udakishunganj, Madhepura in P. S. Case No. 16 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
