2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 120(B) of the I. P . C and u/s 27 of Arms Act .

3. As per the prosecution case, the petitioner has shot dead the deceased Manoj Manjhi and Baleshwar, as they used to steal liquor from their stocks.

4. It is submitted on behalf of the petitioner that his name transpired during course of investigation on confessional statement of other co-accused persons . It is further submitted that there is no material on record to show the complicity of the case. Petitioner has got no criminal antecedent of excise act as such he cannot be said to be a liquor mafia.

5. However, learned counsel for the State opposes the prayer for bail and stated that this petitioner had opened fire on the deceased due to which he died and he has also got three criminal antecedents of the similar nature .

6. Considering the facts and circumstances of the case and also the fact that petitioner has got three criminal antecedents of the similar nature , prayer for pre-arrest bail of the petitioner is rejected.
