The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and other Sections of the Indian Penal Code.

The informant stated that Kaushalya Devi her sister-inlaw (Gotni) raised alarm to open the door and thereafter four criminals entered into her house and slit the neck of her husband causing his death on the spot. The informant further stated that Kaushalya Devi her brother-in-law Sugamal Singh and others killed the husband of the informant.

Submission is that the petitioner is not named in the FIR. Name of the petitioner figured in the case in the confessional statement of Kaushalya Devi and Antu Ram. Save and except

Patna High Court Cr.Misc. No.40074 of 2015 (2) dt.09-09-2015 2/2 confession the police did not collect any further evidence. Kaushalya Devi has already been enlarged on bail vide orders passed in Cr. Misc. No. 10863 of 2013. Antu Ram has also been enlarged on bail vide orders passed in Cr. Misc. No. 18493 of 2013.

Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in Navi Nagar P.S.
