JUSTICE SUDHIR SINGH ORAL ORDER 09-10-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)A, 26, 35 of the arms Act. The prosecution story in brief is that on checking of vehicles, the Police apprehended one country-made pistol from the dickey of the petitioner's motorcycle.

It has been submitted of behalf of the petitioner that the petitioner is in custody since 13.05.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. Petitioner has got no criminal antecedent. As per the prosecution case, one countrymade pistol is said to have been recovered from the dickey of the

Patna High Court Cr.Misc. No.39163 of 2015 (3) dt.09-10-2015 P2/2 motorcycle. The same is denied by the petitioner. It has been submitted on behalf of the State that petitioner is named in the First Information Report.

Considering the aforesaid facts and circumstances, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Kashichak P.S. Case No. 41 of 2015.
