2. The petitioner seeks regular bail in connection with Nokha P.S. Case No. 407 of 2024 registered for the offence under Sections 80, 3(5) of the BNS.

3. The petitioner is the husband of the deceased. The allegation against the petitioner is that he has killed his wife due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 30.10.2024. He further submits that the deceased has committed suicide and there is no antemortem injury on the dead body of the deceased. He lastly submitted that the trial is also not progressing.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as the period of custody, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Rohtas at Sasaram/concerned Court below in connection with Nokha P.S. Case No. 407 of 2024 subject to condition that:- (i). The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bond of the petitioner.
