The petitioner is languishing in custody since 15.03.2019 in a case registered for the offences punishable under Sections 392 and 394 of the IPC.

It is alleged that the motorcycle of the informant and some documents were robbed by some miscreants, leading to registration of FIR against unknown persons. The name of the petitioner sprang up during investigation, on the statement of apprehended co-accused, Vishal Kumar Singh.

It is submitted by learned counsel for the petitioner that recovery has not been made from the conscious physical possession of the petitioner. A statement has been made in

Patna High Court CR. MISC. No.34736 of 2019(2) dt.28-05-2019 2/2 paragraph no.3 of the petition that the petitioner is also accused in two other cases, in which, he is on bail. The petitioner has never been put on T.I. parade.

Learned APP submits that the name of the petitioner sprang up on the confession of apprehended co-accused person. Considering the nature of accusation and period under custody, let the above named petitioner be released on bail on 15.06.2019 on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned ACJM-II, Saran at Chapra in connection with Amnour P.S. Case No. 236 of 2018.
