Petitioner apprehends arrest in a case registered for the offences punishable under Sections 307/34 and other allied sections of the Penal Code.

Prosecution case in short is that the petitioner and other FIR named accused persons on 8.11.2018 at 1 AM reached at the door of the informant and abused her. Accused Mahesh Choudhary and Santosh Choudhary caught her arms and on orders of accused Renu Devi the petitioner fired on the informant causing pillet injury in her left leg. Learned counsel for the petitioner submits that the injuries sustained by the informant were simple in nature. Moreover, good relation has been restored between the parties and compromise petition has also been filed in the court below.

Patna High Court CR. MISC. No.34831 of 2019(2) dt.29-05-2019 2/2 Petitioner has no criminal antecedent. There is a land dispute between the parties.

Considering the facts of the case, let the petitioner, above named, in the event of her arrest/surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Addl. Chief Judicial Magistrate 1st Hilsa in Chandi Police Station Case No. 360 of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
