2. The petitioner seeks regular bail in connection with Khagaul P.S. Case No. 74 of 2025 lodged on 19.02.2025 under Sections 109 and 309(6) of the B.N.S., 2023.
3. As per the prosecution's case, the F.I.R. has been lodged against 8-10 unknown accused persons. It is alleged that these accused persons snatched a gold chain, a bracelet, 5,000 ₹ in cash, and a mobile phone from the informant's friend. They are also accused of having assaulted the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that the petitioner's name does not appear in the F.I.R.; it has surfaced solely on the basis of a confessional statement made by a co-accused. At the time the Sessions Judge rejected
Patna High Court CR. MISC. No.34347 of 2025(2) dt.03-06-2025 2/2 his bail application, the investigation was still pending. However, during the pendency of the present application, the investigation has been completed, chargesheet has been filed, and two co-accused (similarly situated) were granted regular bail by the Court of Additional Sessions Judge-I, Danapur, in B.P. No. 567 of 2025 on 28.05.2025. The petitioner is in custody since 20.02.2025 and has no prior criminal antecedents.
5. Learned counsel for the State opposes the prayer for bail, submitting that although the petitioner's antecedents are clean, his name has been implicated in this case solely by virtue of the co-accused's confessional statement.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) as mentioned in Section 2(1) (d) of the BNSS, 2023 to the satisfaction of learned ACJM-V, Danapur, in connection with Khagaul P.S. Case No. 74 of 2025, subject to the conditions as laid down under Section 480(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Dr. Anshuman, J) Ashwini/- U T
