2. The petitioner has prayed for bail in connection with Sasaram(Mu) P.S. Case No. 218 of 2017 registered for the offence punishable under Sections 3 and 4 of the Explosive Substances Act, Sections 4 and 40 of Bihar Mining Act and Sections 33, 41 and 42 of Indian Forest Act.

3. The case of the prosecution is that from a truck and tractor, explosive materials were recovered and at that place a bike was also recovered.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this

Patna High Court CR. MISC. No.36545 of 2025(4) dt.01-09-2025 2/2 case. His name has surfaced in this case because he is the owner of that bike. Nothing has been recovered from his possession. He is having criminal antecedent of one case in which he is on bail. He is languishing in judicial custody since 05.02.2025.

5. Learned APP appearing for the state has vehemently opposed the prayer of bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Rohtas in connection with Sasaram (Mu) P.S. Case No. 218 of 2017.
