2. This is the third attempt of the petitioner for grant of regular bail in connection with Manjhagarh P.S. Case No. 284 of 2023 registered for the offence under Sections 341, 323, 447, 325, 307, 302, 504 and 506/34 of the Indian Penal Code.
3. The petitioner has also moved to the Hon'ble Supreme Court for grant of bail vide Special Leave to Appeal (Crl.) No. 18369 of 2025 and the Hon'ble Supreme Court has passed the following order:- We dispose of this Special Leave Petition by directing the concerned Sessions Court to conclude the trial within a period of three months from today. In the event the trial is inconclusive by then, the petitioner shall have the liberty to move for bail. If such an application is filed by the petitioner
Patna High Court CR. MISC. No.34897 of 2026(2) dt.03-07-2026 2/2 herein, the same shall be considered on its own merits as expeditiously as possible and in accordance with law.
Pending application(s), if any, shall stand disposed of.
4. Learned counsel for the petitioner submits that the prosecution witnesses have already been examined and the case is pending for examination of defence witnesses.
5. The defence witnesses are to be examined by the accused and the prosecution has no say in the same.
6. In view of the above, this application is dismissed.
7. The trial Judge is directed to hold the trial on day to day basis and will examine the defence witnesses on the dates fixed and will not allow the prosecution to delay the examination of the defence witnesses. He will also not grant unnecessary adjournment at the time of final argument and conclude the trial within one month from today and file a report in this Court after one month from today.
