The petitioner is languishing in custody since 10.01.2015 in a case registered for the offences punishable under Sections 395 of the Indian Penal Code.

The prosecution case is recorded on the basis of the fardbeyan of the informant according to which 14-15 persons have entered in the house of the informant and at the point of pistol, they have committed a robbery in the house of the informant from where they have looted mobiles, ornaments and have also taken an amount of Rs. one lakh and thereafter they opened fire and managed to flee away. They even assaulted the lady members of the informant.

No.16344 of 2015 (4) dt.12-08-2015 2/2 Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. and his name figured in the confessional statement of Md. Jahid. It is also submitted that the petitioner has not been put on Test Identification Parade. A Co-ordinate Bench of this Court has already been granted bail to Md. Jahid, passed in Cr. Misc. No. 18391/2015 vide order dated 15.06.2015.

I see no reason to take a different view and in such circumstances, the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge, III, Sitamarhi in connection with Nanpur P.S.Case No. 12/2015.
