Through this writ application, the petitioner seeks direction to the respondent no.2 to consider his case for promotion to the post of Sectional Officer from the post of Assistant in Bihar Vidhan Sabha as he claims that the Assistant, namely, Chhote Paswan, who is junior to him in service, has already been granted such benefit.

It is contended on behalf of the petitioner that he has filed a representation in this regard on 18.07.2016 before the respondent no.2 but no decision has been taken as yet.

Accordingly, this writ application is being disposed of

Patna High Court CWJC No.14097 of 2016 dt.19-01-2017 2/2 with liberty to the petitioner to approach the respondent no.2 afresh by filing a fresh representation along with a copy of this order. In such case, let the respondent no.2 take a decision in the matter on its own merit and in accordance with law within a period of three months from the date of filing of such representation.
