Heard the learned counsel for the petitioners and learned APP for the State.
The petitioners apprehend their arrest for the offences alleged under Sections 341, 323, 324, 379, 307, 504 and 34 of the Indian Penal Code, registered in connection with Kotwa P.S.Case No. 195 of 2020.
As per allegation, the accused persons assaulted the members of the informant's side. The allegation against petitioner no.1 is that he assaulted Mantu Yadav and petitioner no.2 assaulted Suresh Yadav, whereas petitioner no.3 assaulted Yamuna Yadav.
The learned counsel for the petitioners has submitted that the injured persons have sustained simple injuries. He has
Patna High Court CR. MISC. No.45368 of 2021(2) dt.13-04-2022 2/2 submitted further that there was land dispute between the parties. He has also submitted that all the disputes including he present case and counter case have been compromised between the parties.
Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Kotwa P.S.Case No. 195 of 2020, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
