The petitioner apprehends his arrest in Excise Case No.738 of 2020 arising out of Piro P.S. Case No.114 of 2020 registered under Section 30(a) of Excise Act. The police intercepted a motorcycle but the motorcyclists managed to flee away. 9 litres of mahua liquor was recovered from the motorcycle. The name of the petitioner figured in the case on the basis of the disclosure made by the villagers but the informant did not disclose the name of those persons who disclosed the name of the petitioner. The learned counsel for the petitioner submits that petitioner is not the owner of the vehicle and petitioner has no manner of concern with the liquor or the vehicle. Petitioner has got no criminal antecedent.

No.34987 of 2020(2) dt.18-03-2021 2/2 Taking into consideration the facts that petitioner is not the owner of the vehicle and the fact that informant disclosed the name of the petitioner said to have been disclosed by the villagers, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. IV-cum-Special Judge, Bhojpur at Ara in connection with Excise Case No.738 of 2020 arising out of Piro P.S.
