This appeal has been preferred on behalf of the appellant under Section 14-A (2) of the SC & ST (Prevention of Atrocities) Act (for short 'the Act') for setting aside the order dated 11.11.2022, passed by the learned 1st Additional Sessions Judge-cum-Special Judge (SC/ST) Act, Siwan in connection with Guthani P.S.Case No. 269 of 2021, registered for the offences punishable under Sections 302, 120(B) and 34 of the Indian Penal Code and Section 3(2)(v) of the Act, whereby the prayer for bail of the appellant has been rejected.

3. According to the allegation, accused persons, who were in ambush, caught hold of the son of the informant and the

Patna High Court CR. APP (SJ) No.2073 of 2025(5) dt.19-09-2025 2/2 appellant fired six round of shots at his head. The son of the informant died at the spot.

4. The learned counsel for the appellant has submitted that although the bail petitions of the appellant have twice been rejected by this Court, but he is renewing his prayer for bail on the ground of his prolonged incarceration and snail's pace of the trial. He submitted further that out of nine charge-sheeted witnesses, only four have been examined till date.

5. I do not see any reason to re-consider my earlier orders, declining the privilege of bail to the appellant. The appeal is accordingly rejected.
