====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 15-09-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks regular bail in connection with Sessions Trial No.626 of 2022 arising out of Katoriya P.S. Case No.41 of 2020 dated 12.03.2020, lodged under Sections 302, 201, 34 of the Indian Penal Code.

3. Learned counsel for the petitioner submits that vide order dated 28.11.2022 regular bail application of the petitioner has been rejected granting liberty that he may renew his prayer for bail after four months from the date of framing of charge. He further submits that charge has been framed on 17.01.2023 and four months have already been lapsed.

4. The report has been called for in this case which has been received and from the trial report, it transpires that

Patna High Court CR. MISC. No.37580 of 2023(4) dt.15-09-2023 2/2 Court is demanding further nine months for completion of evidence.

5. Learned counsel for the State opposes the prayer for bail.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-I, Banka in connection with Sessions Trial No.626 of 2022 arising out of Katoriya P.S. Case No.41 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

7. With this observation, the bail application stands allowed.
