Petitioner was driver of the tractor of the informant and admittedly, stolen tractor has not been recovered from possession of the petitioner and the said recovery has been made from the possession of co-accused Fantus Kumar.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner does not have any criminal antecedent and is languishing in jail custody since 19.2.2015, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Sri R.K.Verma, Judicial Magistrate, Ist Class, Barh, Patna/ concerned court in Hathidah P.S. Case no. 72/2014.
