The petitioner is languishing in custody for the offence punishable under Sections 364, 364A, 384, 386 and 506/34 of the Indian Penal Code.

According to F.I.R., the petitioner and three others forcefully kidnapped the minor son of the informant on a four wheeler. Thereafter, the petitioner and co-accused Rahul repeatedly demanded ransom on mobile phone. The mobile number is referred in the F.I.R. The investigation report reveals that for non fulfillment of ransom, the victim was done to death, that has come in the confessional statement of co-accused. Patna High Court CR. MISC. No.34229 of 2020(3) dt.22-02-2021 2/2 which was recovered from the possession of the petitioner. On the basis of location and identity, the petitioner and co-accused were apprehended and from possession of the petitioner, a loaded country made pistol besides the mobile in which the SIM referred in the F.I.R. was used was recovered. Learned counsel for the petitioner submits that the petitioner is in custody since 23.10.2019. Petitioner is ready to cooperate with the trial.

Considering the nature of allegation against the petitioner as well as his criminal antecedent and non grant of bail to co-accused Rahul Kumar by a co-ordinate Bench of this Court, I am not inclined to enlarge the petitioner on bail in connection with S. Tr. No. 276 of 2019 arising out of Kanti (Panapur O.P.) P.S. Case No. 486 of 2018.

Hence, prayer is refused.
