The petitioner seeks bail in G.R. Case No.02 of 2017 registered under Section 20 (b) (ii) of (B) of the N.D.P.S. Act and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. 15 kgs. of Ganja is said to have been recovered from the bag allegedly hailing to the petitioner from the dicky of the bus bearing registration no.BR 02W 1888.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the conscious physical possession of the petitioner. He has been falsely implicated in this case. He has no concern either with the said bus or with the alleged bag. He has also no concern with the

He happens to be simple commuter of the said bus and had no knowledge of keeping the aforesaid contraband in the dicky of the bus. He has no criminal antecedent and has been languishing in custody since 05.02.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge (N.D.P.S. Act), Aurangabad in connection with G.R. Case No.02 of 2017.
