2. Despite the notice having been served upon O.P. No.2, there is no appearance on her behalf.
3. The petitioner apprehends his arrest in connection with Simraha P.S. Case No.54 of 2024 registered for the offences punishable under Sections 341 and 498A/34 of the Indian Penal Code.
4. Learned Advocate for the petitioner submitted that, in fact, the petitioner and the daughter of O.P. No.2 were in love affair and later on, on the intervention of local people, the marriage was solemnized. The wife of the petitioner has never

No.38052 of 2025(3) dt.08-10-2025 2/3 made any complaint but it is the mother of the wife, who had instituted the present FIR but later on, on the pressure being made, his wife has also filed Complaint Case No.1037/2024. The petitioner has tried his best to bring back his wife but she has not ready to come to her matrimonial home. The petitioner is also ready to settle the matrimonial dispute but there is no cooperation on the part of O.P. No.2 and her daughter. The petitioner undertakes that he will fully cooperate in the proceedings of the Court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application.
6. Having considered the submissions set forth by the learned Advocate for the respective parties and considering the fact that the petitioner is husband facing two identical nature of cases, one instituted by the mother-in-law and another by his wife with an omnibus nature of allegation of torture and demand of dowry, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M. Araria in connection with Simraha P.S. Case No.54 of 2024, subject to the
Patna High Court CR. MISC. No.38052 of 2025(3) dt.08-10-2025 3/3 condition as laid down under Section 482(2) of the BNSS, with further condition that one of the bailors shall be the own/close family members of the petitioner.
