The petitioner seeks bail in Shahpur P.S. Case no. 70/2012, registered for the offences punishable under Sections 498A, 323, 380 and other Sections of the Indian Penal Code. The wife made allegation of assault and demand of dowry. The petitioner was granted anticipatory bail with condition that if his wife file affidavit stating her willingness to the petitioner, the provisional bail of the petitioner will be confirmed, but the wife did not file any such affidavit. Consequently, the provisional bail of the petitioner was cancelled. The petitioner was taken into custody on 28.04.2015, since then the petitioner is in jail. He has already remained in jail for more than four months.
