The petitioner seeks bail in a case registered for the offences punishable under Section 384 of the Indian Penal Code. As per the prosecution story, the petitioner is alleged to have demanded rupees ten lakh as ransom from the informant with a threat that if not paid within the given time, then ready to face dire consequences.
It has been submitted of behalf of the petitioner that the petitioner is in custody since 12.06.2015. Chargesheet has been submitted in the present case. There is no allegation of tempering with the evidence against the petitioner. As per the allegation, the petitioner is said to have demanded Rangdari. From perusal of the First Information Report, it appears that some amount has been
Patna High Court Cr.Misc. No.39087 of 2015 (3) dt.09-10-2015 P2/2 paid by the informant to the petitioner. Petitioner has falsely been implicated in the present case. It has further been submitted that the petitioner may be released after completion of the nine months in custody from 12.06.2015.
It has been submitted on behalf of the State that petitioner is not named in the First Information Report.
Considering the aforesaid facts and circumstances, the petitioner may be released on bail after completion of nine months in custody since 12.06.2015 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Jogbani P.S. Case No. 15/2015. (Sudhir Singh, J) Saif/- U T
