The petitioners are in custody in connection with Nayagaon P.S. Case No. 33 of 2019 for the offence under Sections 30/38/41 of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioners submits that the petitioners have got no criminal antecedent and the petitioner no.1 is in custody since 20.03.2019 and petitioner no.2 is in custody since 19.04.2019. He further submits that in the instant case total 180 litres of country made liquor was seized. He also submits that nothing was seized from the conscious possession of the petitioners.

No.35293 of 2019(2) dt.29-05-2019 2/2 Considering the fact that the petitioners have got no criminal antecedent and nothing was recovered from the conscious possession of the petitioners, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-IX-cum-Special Judge, Excise Act, Saran in connection with Nayagaon P.S.
