JUSTICE RAKESH KUMAR ORAL ORDER 08-11-2016 Heard Sri Krishna Prasad Singh, learned senior counsel who was assisted by Sri Arun Kumar Pandey, learned counsel for the petitioner and learned Additional Public Prosecutor. The sole petitioner , apprehending his arrest in Bihta P.S. Case No. 737 of 2015 , registered for the offence under Section 20/22 of the Narcotic Drugs And Psychotropic Substances Act , has prayed for grant of anticipatory bail. By way of referring to the F.I.R. it was submitted by learned counsel for the petitioner that the informant has stated that he had got information that wife of the petitioner was indulging in selling of Ganja and thereafter raid was conducted. At the time of raid the wife of the petitioner was fleeing away and she was apprehended and thereafter search was conducted. It has been argued that petitioner being Homeguard was not
Patna High Court Cr.Misc. No.23606 of 2016 (5) dt.08-11-2016 2/2 responsible for any of the allegation, however he accepts that it was his house from where Ganja was recovered. In this case earlier case diary was called for which has been received and kept on record. On perusal of the case diary, I do not find any ground to extend the privilege of anticipatory bail.
The petition stands dismissed.
