The petitioner seeks bail in a case under Section 406, 409, 420 of the Indian Penal Code.

The petitioner is said to have received 8400.00 quintals of paddy and he had to deliver 5628.00 quintals of rice but the petitioner did not deliver 5358.00 quintals of rice, price of which comes to Rs. 1, 16, 03070.48/-.

It is submitted that petitioner has already pledged his lands worth more than the amount lying due against the petitioner. Certificate case is also going on. The petitioner is in jail since 23.07.2015.

Mr. Shailendra Kumar Singh, the learned counsel for the BSFC, has submitted that the petitioner misappropriated huge

Patna High Court Cr.Misc. No.40853 of 2015 (2) dt.03-09-2015 2/2 amount of BSFC.

Considering the facts aforesaid and the fact that landed property worth more than the due lying against the petitioner is pledged with BSFC and the certificate case is also going on, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran, Motihari in Adapur P.S. Case No. 60 of 2015.
