JUSTICE RAVI RANJAN ORAL ORDER 30-01-2016 Heard learned counsel for the petitioner, the State and the Accountant General, Bihar.
It is contended on behalf of the petitioner that though all the dues have already been given to the petitioner but due to negligence of the State Bank of India there was delay of five months for which the petitioner would be entitled for the interest. However, the petitioner had earlier approached this Court by filing C.W.J.C. No. 5070 of 2013 which was disposed of vide order dated 28.11.2013 contained in Annexure 3 stating as under: "Writ application stands disposed of as the stand taken by the State Bank of India in the counter affidavit has not been rebutted."
Patna High Court CWJC No.8964 of 2014 (2) dt.30-01-2016 It does not appear that the petitioner had raised the point of rate of interest at that point of time and the stand taken by the State Bank of India in the counter affidavit was not rebutted by the petitioner.
In my view, now the said grievance cannot be raised by the petitioner now by filing a fresh application. This application is, accordingly, dismissed.
