Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Bakhtiyarpur (Balwahat O.P) P.S. Case No. 336 of 2019, registered under Sections 25(1-b)a, 26 and 35 of the Indian Penal Code.

The accusation is of recovery of country made pistol and six cartridges from the possession of the petitioner. Learned counsel appearing for the petitioner submits that, earlier, the prayer for bail of the petitioner was

Patna High Court CR. MISC. No.34239 of 2020(2) dt.17-02-2021 2/2 refused on 23.01.2020 vide Criminal Miscellaneous No. 4310 of 2020. The petitioner is in custody since 27.08.2019, while the petitioner is accused in five cases, but he is on bail in all cases.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri K.K. Gupta, Judicial Magistrate, Saharsa in connection with Bakhtiyarpur (Balwahat O.P) P.S. Case No. 336 of 2019. One of the sureties must be parents/close relative of the petitioner.
