JUSTICE SATYAVRAT VERMA ORAL ORDER 01-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Amarpur P.S. Case No. 112 of 2021 instituted for the offences under Section 392 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 09.04.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that allegation is of loot of Rs. 50,000/-, a laptop and a mobile from the possession of the informant by four unknown criminals. Learned counsel for the petitioner submits that F.I.R. is against unknown and the name of the petitioner transpired in the confessional statement of police spy. It is further submitted
Patna High Court CR. MISC. No.45292 of 2021(2) dt.01-02-2022 2/2 that the petitioner till date has not been put on T.I.P. and the motorcycle alleged to be recovered from the petitioner is his own motorcycle.
Learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 09.04.2021, charge-sheet has been submitted in the case and the petitioner is a person with clean antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Banka in connection with Amarpur P.S.
