The petitioner is in custody in a case registered under Sections 366(A)/34 of the Indian Penal Code. The prosecution case in, brief, is that on 26.2.2015 at 10 P.M. the daughter of the informant had went to nearby the house to attend feast but she did not return after some time. Then they began to search her and came to know that during search Sunita Devi took away Pramila Kumari, daughter of the informant with her. Then the informant went at his house but not traced out and in the morning the informant came to know that the brother of Sunita Devi namely Babloo Yadav with the help of his sister took away the daughter of the informant and fled away, It has been submitted on behalf of the petitioner that the

Patna High Court Cr.Misc. No.42329 of 2015 (3) dt.16-10-2015 2/2 petitioner has got no criminal antecedent. He is in custody since 16.3.2015.Charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner.From perusal of FIR it would appear that the motive of abduction is for the purpose of performing the marriage between the petitioner and the victim. The petitioner has remained in custody for about seven months.The victim is said to have married with some other person.

On behalf of the State, it has been submitted that the petitioner is named in the FIR.

Considering the facts aforesaid, let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Bhagalpur in Pirpainti P.S.Case No. 58 of 2015.
